Buying a Tenanted Property in Ontario: What Investors Need to Know

by Mathew Toussaint

Plenty of good investment properties in Waterloo Region, Hamilton and Brantford come with tenants already in place. That is not a problem by itself, but you need to understand what transfers with the property, because in Ontario the tenancy does.

You inherit the tenancy, not just the building

When you buy a tenanted property, the existing lease, the existing rent and the tenant's rights come with it. You cannot simply raise the rent to market on closing, and a change of ownership is not a reason to end a tenancy. Review the actual lease, any renewals, the current rent, the last increase date and any agreements about parking, utilities or appliances.

Documents to insist on

  • The signed lease for every unit, ideally on the Ontario standard lease form.
  • A rent roll showing current rents and the date of the last increase for each unit.
  • Proof of last month's rent deposits held, and how they are credited to you on closing.
  • Any outstanding Landlord and Tenant Board applications, orders or arrears.
  • Utility arrangements and who pays what.
  • For a second unit, evidence it is legal: permits, fire code retrofit, zoning.

Vacant possession is not automatic

If you intend to move in yourself, or have a close family member move in, there is a specific process under the Residential Tenancies Act with notice requirements and compensation obligations, and it cannot be used simply to re-rent at a higher price. If your plan depends on the unit being empty, get legal advice before you make the offer.

How it changes your numbers

Underwrite at the actual in-place rent, not market rent. Include a vacancy allowance, maintenance, a capital reserve and the cost of any retrofit work needed. If in-place rents are below market, the upside is real, but it arrives slowly and lawfully, not on closing day.

Getting it right

I run a licensed property management company alongside my real estate practice, so we can review the leases and the operating picture together before you commit. Start with the investor and landlord guide, then get in touch about a specific property.

This is general information, not legal advice.
